All About the MCA DIR 3 KYC Form, including the Due Date and Penalty

A director identification number (DIN) is a unique identifying number assigned to an individual who wishes to become or is already a director of a corporation. DIN is obtained by submitting an application in eForm DIR-3, which was originally a one-time process to be completed by the person who intends to become a director in one or more companies.

Who Must Submit e-Form DIR 3 KYC?

According to recent MCA releases, directors must submit their KYC data to the MCA if they satisfy the following conditions:

  1. According to the MCA department’s notification, each director whose Director Identification Number (DIN) was granted by the 31st of March 2018 must submit his KYC data. Furthermore, the disqualified directors must follow this procedure.
  2. Every director who was assigned a DIN on or before the end of the fiscal year and whose DIN was authorised must file form DIR-3 KYC by September 30th of the next fiscal year.
  3. For example, DIN or Directors Partner Identification Number (DPIN) holders and directors assigned DPIN by March 31, 2023 must complete the eForm DIR-3 KYC by September 30, 2023.

Things to consider while submitting e-Form DIR-3 KYC

  1. When submitting this e-form, the director must provide their cell phone number and email address. 
  2. Directors will be required to use their digital signatures to file this e-Form 
  3. Directors will be required to guarantee that the e-Form is certified by a practicing Chartered Accountant, practicing Cost Accountant, or practicing Company Secretary.

DIR-3 KYC Filing Type

The DIN holder can file and amend their DIR-3 KYC data for the prior fiscal year using an e-Form and web services. These are the two types and information shown below:

Update KYC Details Using e-Form DIR-3

The web services are offered to DIN holders who have already filed the e-Form DIR-3 KYC in prior fiscal years, do not need an update in KYC information, and can do yearly KYC updation.

DIR-3 KYC Update through Web Services

If the DIN holder files the KYC details in the first period as per the MCA, the details of KYC should be filed using the e-Form DIR-3 KYC and the person does not have online services access, the DIN holder must also update the KYC via the e-Form DIR-3 KYC if the update has to be updated. There is no access to online services for DIR-3 KYC updating.

Due Date and Penalty Charges for Failure to Submit DIR 3 KYC Form

When a director fails to file the e-KYC Form or Dir 3 ekyc by the required dates (or extended due date) on MCA 21 portal, the department marks the director’s Director Identification Number as ‘Deactivated owing to Non-filing of DIR-3 KYC’. In such circumstances, the director can reactivate his DIN by submitting the omitted e-Form DIR-3 KYC and paying a late fee of INR 5,000.

Documents Required to File DIR 3 KYC Form 

  1. Nationality Details 
  2. Citizenship Details such as gender, date of birth, etc.
  3. Permanent Account Number (PAN) 
  4. Passport (required if the DIN bearer is a foreign person)
  5. Driving License 
  6. Aadhaar card 
  7. Personal Mobile and Email ID 
  8. Proof of Residential address.
  9. Voter Identification Card

Aside from the documents stated above, directors must additionally have the following items on hand:

  1. His digital signature to file the form; 
  2. Attestation of the above-mentioned papers by a CA, CS, or Cost Accountant who is a member of the profession. In the case of foreign nationals, attestation by the specified authorised person
  3. A declaration signed by them (applicant/director) and duly certified by CA, CS, or Cost Accountants in good standing.

Step-by-Step Instructions for Filing the DIR 3 KYC Form

Step 1: Download the form 

  • The first most important step is to download the latest versionDIR-3 KYC form from the MCA Official website. 

Step 2: Fill in the DIN data 

  • Directors must fill in the DIN in the KYC form, which has a ‘Approved’ status.
  • Directors who have had their DIN cancelled owing to non-submission of KYC Forms may complete the form beyond the statutory due date by paying late filing fees.

Step 3: Fill the DIR- 3 KYC Form with the Required details.

Name and any relevant credentials

The applicant must include his first and surname name, as well as his father’s first and last name. A few important points to keep in mind:

  • The director must put his name as it appears on his PAN.
  • The address entered in the form will be verified against the PAN database.
  • Single alphabets, acronyms, and abbreviations are not allowed.
  • A director must state his nationality. 
  • Directors with foreign nationality must declare the nationality shown on their passport.

Declaration of Age

A director’s date of birth (DOB) must be entered in the DD/MM/YYYY format. Age declaration is required since anybody under the age of 18 is ineligible to make this application.

Address

A director must include his permanent residence address and provide evidence of residency. When the current residential address differs from the permanent residential address, the current residential address must be provided.

Step 4: PAN Verification.

Verification of the Permanent Account Number (PAN) is required. A director must first input his PAN before clicking the ‘Verify income-tax PAN’ button. The system next checks the director’s information using the PAN card number.

Step 5: Update Contact Information and Confirm OTP

  • A director must update his contact information by entering his mobile number and e-mail address, which is verified through an OTP. 
  • After entering these details, the director must verify them through an OTP by clicking on the ‘Generate OTP’ button. Separate OTPs are sent for mobile numbers and email addresses. 
  • Only directors who are not Indian residents are permitted to enter country codes other than +91/91/0. 
  • It should be noted that an OTP will be successfully sent to the mobile number and email address a maximum of 10 times per day and twice in 30 minutes against one form.

Attachments must be attested.

An applicant must testify to and upload the papers listed below.

Please keep in mind that any additional attachments must be digitally signed by the applicant.

Step 6: e-Form Authentication

The e-Form must be validated, which means it must be digitally signed by a Chartered Accountant/Cost Accountant or a Company Secretary who is a member of the profession. It is impossible to avoid providing the data of the practising professional as well as their digital signature.

Step 7: Create an SRN

When the e-Form DIR-3 KYC is successfully submitted, an SRN is produced and assigned to the user for future contact with the MCA.

Step 8: Email correspondence

On his personal email ID, the applicant will get an email acknowledging receipt of the form.
